Terms of use
The agreement between you and us when you use the directory or the software. It covers your account, what you pay, what we do and do not promise, and what happens when either of us wants to stop.

These terms are an agreement between you and Buyers Agents Technologies Pty Ltd (ABN 95 695 266 150), trading as Buyersagents.com.au, BuyersagentsOS and PropDive. In this document, "we" and "us" mean that company, and "the platform" means all three of those products together.
By using any of them you accept these terms. If you do not accept them, do not use the platform. How we handle information is set out in our Privacy policy, which sits alongside this document rather than inside it.
01What we run
- The directory
- A public list of Australian buyer's agents. Anyone can search it, read reviews and send an enquiry to an agent. Agents can claim their profile, keep it current and take enquiries through it, on a free plan or a paid one.
- BuyersagentsOS
- Software an agent or an agency subscribes to: contacts, deals, documents, email, calendar, calls, reports, forms and the modules listed on our pricing page. It runs on a subscription and some parts of it are charged per use.
- PropDive
- Property research and due diligence reports, built on data we license from third parties.
We are not a real estate agency and we are not a buyer's agent. We do not act for you in a purchase, we do not take a commission on one, and we do not check how well any agent on the directory does their job.
02Your account
You need an account to claim a profile or to use the software. Give us accurate details and keep them current.
An account belongs to one person. Keep your password to yourself, and tell us if you think someone else has it. Everything done under your account is treated as done by you.
03Agencies, seats and invitations
An agency is a workspace several people share. Being an active member of the agency is what gives you access to it. A seat is a paid place on the agency's subscription that carries the paid product for the person in it, and the agency is the payer.
Someone becomes a member of an agency in one of three ways:
- a manager invites them and they accept;
- they ask to join and a manager approves it; or
- a manager brings back a member who had left.
A manager chooses at that point whether the agency takes a paid seat for them. Not every member costs the agency money: someone on their own subscription, and the agency's compliance officer, do not.
If a member leaves, or a manager removes them, their membership ends and their access to the workspace ends with it. The seat does not end with them. It stays on the agency's subscription, empty, and keeps billing until a manager releases it from the Team screen or puts someone else in it. Work the member did stays with the agency.
An invitation is sent to one email address and only that address can accept it. Signing in with a different address will not let you take the invitation, on purpose - it is how we keep someone from joining an agency that did not ask for them.
The agency's records - its clients, deals and documents - belong to the agency, not to the individual member. If you are a member rather than the owner, take your own copy of anything you need before you leave.
04Your profile on the directory
You are responsible for what your profile says. It must describe you and your real business, and the licence details on it must be current.
Free profiles do not show contact details. Your email address, phone number and any other way of reaching you directly are held back on the free plan and shown on a paid one. You must not work around that - no contact details written into your description, your photo captions or any other free-text field, and no links whose purpose is to move an enquiry off the platform. A profile that does it can be unpublished or removed.
Your photo must be a clear, current photo of you. We can review photos at any time and unpublish a profile whose photo is misleading, unclear or not of the person the profile names.
05Reviews and what you post
A review must be honest and about something that actually happened to you. Do not post anything false, misleading, defamatory, offensive, discriminatory or unlawful, and do not post a review of yourself, your own agency or a competitor.
We can decline to publish a review or take one down. If you are the agent a review names, you can ask us to look at it again, and we will - but we decide, and we are not obliged to settle an argument between an agent and a client.
Reviews are the opinions of the people who wrote them. Publishing one is not us endorsing or recommending the agent.
When you post something, you keep it and you give us a perpetual, worldwide, royalty-free licence to store, display and share it as part of the platform.
06Property data from Cotality
Sales history, property attributes, suburb statistics and estimated values in BuyersagentsOS and PropDive are licensed to us by Cotality (formerly CoreLogic) and by the state authorities Cotality sources from. That data comes with its own terms, which you accept when you use it, and they are set out in full in our Cotality data terms. Read them - they include restrictions on what you may do with the data that these terms do not repeat.
An estimated value is a computer estimate, not a valuation, and no figure on this platform is a valuation for a lender, a court or the tax office.
Cotality data is not sent to any AI provider. It is fetched and shown to you, and it is kept out of anything the Copilot is given to read.
07What the Copilot writes
BuyersagentsOS includes a Copilot that drafts emails, notes and summaries from what is already in your workspace. It proposes; you decide. Nothing it drafts is sent, filed or acted on until you do it.
Read what it writes before you send it. AI drafting gets things wrong, and a draft you send is your message, in your name, and your responsibility. Nothing it produces is legal, financial or property advice.
Which providers process what, and on what terms, is set out in section 06 of our Privacy policy.
08Signing documents
You can send a document for signature through BuyersagentsOS. It sends the document to the people who need to sign it and records who signed, from where and when. We run the signing software ourselves rather than buying it from a signing company; section 05 of our Privacy policy says where it is hosted.
We do not check any of the following, and you should not assume we have:
- that the document is the right one for your state or your transaction;
- that the person who signed is who the email address says they are; or
- that the signed document has the legal effect you intend it to have.
Choosing the document and satisfying yourself that it is validly signed is your job. Get your own advice where it matters.
09The anti-money-laundering module
BuyersagentsOS has a module for client due diligence: collecting information, running identity checks, and keeping the records of what you did. These are the words you agree to when you switch it on, and they hold here too:
- Your business is the reporting entity and remains responsible for meeting its obligations under Australia's AML/CTF laws.
- BuyersagentsOS provides tools to support client due diligence, including collecting information, completing checks and maintaining compliance records.
- BuyersagentsOS does not act as your AML/CTF compliance officer, maintain your AML/CTF program, or make regulatory reports to AUSTRAC on your behalf.
A check result is a record of what a check returned on the day it ran. It is not a decision about whether to take on a client, and it is not legal advice.
10Using the platform properly
You must not:
- scrape, copy or resell the directory, its listings or its reviews;
- use anyone else's account, or share yours;
- use one seat for several people, or a personal account to do an agency's work in order to avoid paying for seats;
- send bulk email through the platform to people who have not agreed to hear from you;
- upload anything malicious, or try to reach data that is not yours; or
- use the platform to break a law, including the Privacy Act and the Spam Act.
You must have the right to give us the information you put in - your clients' details, their documents and their identity records included - and you must handle what you take out of the platform as carefully as we handle it in.
11Fees, GST and renewals
- Currency and GST
- All prices are in Australian dollars and exclude GST. GST is added at checkout, and every price we show says so.
- Billing
- Subscriptions are billed in advance, monthly or annually depending on the plan you choose. Seats are billed to the agency as part of the agency's subscription.
- Renewals
- A plan renews automatically until you cancel it. Cancel before the next billing date and you will not be billed again.
- Cancelling
- You may cancel at any time. Your plan runs to the end of the period you have paid for. We do not give part refunds for time you have not used, unless the Australian Consumer Law says we must.
- Payment
- You authorise us to charge the payment method on your account for your subscription, for seats your agency adds, and for anything you buy in the product. Card details are held by our payment provider, not by us.
- Price changes
- We can change our prices with 30 days' notice to you. If you do not want the new price, cancel before it takes effect.
- Unpaid accounts
- If a payment fails and stays unpaid, we can suspend access to the paid parts of your account until it is settled.
12Credits
Some things you run on a client - identity checks and property reports - are paid for with credits rather than being included in the plan. A credit is $1 plus GST.
Every BuyersagentsOS plan includes an allowance of credits each month, and that allowance resets at the start of each month rather than carrying forward. Credits you buy in a pack do not expire.
A credit is spent when the check or report runs. It is spent whether or not the result is useful to you.
13Who owns what
The platform itself - the software, the design, the logos and the name - is ours or licensed to us. You may use it; you may not copy it, resell it, or take it apart to build something like it.
What you put in is yours: your profile, your contacts, your documents, your clients' records. We hold it to run the platform for you, and section 14 of our Privacy policy says how you get a copy of it.
The directory as a whole - the listings and ratings collected together - is ours, and so is anything we build from platform activity that does not identify a person.
Data licensed from third parties, including Cotality, stays theirs. Your right to use it ends when your access to the platform ends.
14What we do not promise
We provide the platform as it is. We work to keep it running and accurate, and we do not promise that it will be uninterrupted, error-free, or right about everything.
In particular, we do not warrant:
- that any agent listed will do good work, or is right for you;
- that reviews, ratings or agent-supplied details are accurate;
- that property data, estimates or statistics from third parties are complete or current; or
- that anything the Copilot drafts is correct.
To the extent the law allows, we are not liable for loss or damage arising from your use of the platform, from anything an agent or a client does, or from an error or delay in content that came from someone else.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law. Where a guarantee under that law applies and cannot be excluded, and the law allows us to limit what we do about it, our liability is limited to supplying the service again or paying the cost of having it supplied again.
You are responsible for what you do on the platform. If something you do or post causes a claim against us, you cover us for it.
15Ending it
You can ask us to close your account at any time, from the privacy page in your settings. We review the request before anything is deleted. Ending a paid plan is a separate act and is covered by section 11.
We can suspend or close an account that breaks these terms, and we can unpublish a profile or a review while we look into something. Where we can, we will tell you why and give you a chance to fix it first; where the breach is serious or ongoing, we may act first.
When an account closes we keep some records for as long as the law requires, and delete or de-identify the rest. What is kept, and for how long, is in section 10 of our Privacy policy.
16Changes to these terms
We update these terms as the product changes. The effective date at the top of this page is how you tell which version you are reading, and we change it only when the words change.
For a change that materially affects you we will tell you before it takes effect, by email or in the product. Continuing to use the platform after that is how you accept the new terms.
17Complaints
Tell us at support@buyersagents.com.au and we will look at it. Give us what you can - the profile, the review, the invoice, the date - so we are looking at the same thing you are.
Before either of us starts legal proceedings, we both agree to try to sort it out directly.
If it is a privacy complaint, section 15 of our Privacy policy sets out how we handle it and how to take it to the Office of the Australian Information Commissioner if you are not satisfied.
18Governing law
These terms are governed by the laws of Queensland, Australia, and both of us submit to the courts of Queensland.
If a clause here turns out to be unenforceable, it is severed and the rest still stands.
